The legal systems of the contemporary Western world are usually divided into two groups: the common law and the civil law. Common Law is body of customary Law and developed originally in England, forms the general basis for the legal order of the United States.
Civil Law also called Romanistic-German Law, the Law of continental Europe, based on an admixture of Roman, Germanic, feudal, commercial, and customary law. In the civil law systems large area of private law are codified.
A contract formed when there is an agreement between the parties to undertake certain obligations. A contract is formed at the moment the offer is accepted by offeree. Each contract has two essential elements:(1)-Intention to enter into a legally binding agreement and (2)-consideration.

Today the legal systems of Latin America, parts of Africa, and much of Asia are considered to be within – or strongly influenced by – the civil law tradition. It is to be noted that both systems have been developed within the western European culture; the hold many values in common. Both are products of Western civilization. .
A contract is formed when there is an agreement between the parties to definite offer by one person to do a certain thing and an unconditional acceptance of the offer by the other. The contract is formed at moment the offer is accepted and any attempt to vary or qualify an offer once it has been accepted will not succeed.
For there be a legally enforceable contract the parties must have intended to enter into a legally binding agreement. this intention is seldom stated but it is usually inferred from the circumstances surrounding the agreement.
